These Terms and any Contract between yourself and Badger Trust are only available in the English language.
Please note that these Terms are governed by English law. This means a Contract for the purchase of Products through our Website and any dispute or claim arising out of or in connection with it will be governed by English law.
You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
1. Information about us
1.1 We operate the website shop. We are Badger Trust, a limited company registered in the UK, and a charity registered with the Charity Commision (England and Wales) under charity number 1111440. Our registered office is Badger Trust, Citibase, 95 Ditchling Road, Brighton, BN1 4ST.

1.3 The regulatory compliance associated with the application, use and processing of any Products is your responsibility.
2. Our Products
2.1 The images of the Products on our Website are for illustrative purposes only. Although we have made every effort to present the colours accurately, we cannot guarantee that your computer's display of the colours will replicate the colour of the Products. The products you receive may vary slightly from those images.
2.2 All sizes, weights, capacities, dimensions and measurements indicated on our Website have a 5% tolerance.
2.3 The packaging of the Products may vary from that shown on our Website.

2.4 If for any reason we are unable to fulfill your order for a Product we will advise as soon as possible and offer a full refund. We aim to avoid this situation, but sometimes an online stock level may differ from the actual number of products held.
3. How we use your personal information
We only use your personal information in accordance with our Privacy Notice. Please read this as it includes important terms which apply to you.
4. Your rights as a consumer
4.1 You may only purchase Products from our Website if you are aged 18 or over.
4.2 You have legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect your legal rights.
5. How the contract is formed between yourself and Badger Trust.
5.1 For the steps you need to take to place an order on our Website, please see the shop home page.
5.2 Our order process allows you to check and amend any errors before submitting your order to us. Please read and check your order at each stage of the order process.
5.3 You can only pay for Products online by using a debit card, credit card or PayPal. We accept the following cards: Visa, Visa Debit, Visa Electron and Mastercard. We do not accept American Express Cards. Payment for the Products, plus all expected delivery charges, is charged to your card when the order is accepted. If we are shipping overseas we may have to contact you to confirm exact costs, due to recent customs changes due to Brexit.
5.4 Once you have submitted an order you will receive an email acknowledging that we have received it and that your order has been accepted.
5.5 The Contract between us is formed when we send the acknowledgement email.
5.6 See Section 2.4 for the procedure we follow if we are unable to supply a Product for any reason.
6. Our right to vary these terms
6.1 Revised terms will apply if there are changes in how we accept payment from you.
6.2 Changes in relevant laws and regulatory requirements will also affect the terms.
6.3 Every time you order Products from us, the Terms in force at that time will apply to the Contract between us.
6.4 Whenever we revise these Terms in accordance with this Clause 7, this document will be amended. The date of amendment will be shown at the foot of the last page.
7. Your consumer right of return and refund
7.1 As a consumer, you have a legal right to cancel a Contract under the Consumer Contract Regulations (2014) during the period stated in Section 8.3. This means that during the relevant period if you change your mind or for any other reason you decide you do not want to keep a Product, you can notify us of your decision to cancel the Contract and receive a refund. Advice about your legal right to cancel the Contract under these regulations is available from your local Citizens' Advice Bureau or Trading Standards office.
7.2 This cancellation right does not apply in respect of any made to measure or custom-made products; newspapers, periodicals or magazines; perishable goods and software, DVDs or CDs which have a security seal which you have opened or unsealed.
7.3 Your legal right to cancel a Contract starts from the date when the Contract between us is formed, see Section 6.5. If the Products have already been delivered to you, you have a period of 14 days in which you may cancel, starting on the day after the day you receive the Products.
7.4 To cancel a Contract please email us at sales@badgertrust.org.uk. The cancellation takes effect from the date of the email. You then have 14 days to send the Products back to us.
7.5 Provided the Product is returned in good condition, e.g. fit for resale, you will receive a refund of the full price you paid, including cost of postage to you, for the Product within 14 days of receipt of the Product by us.
7.6 If you have returned the Product under this Clause 8 because it is faulty or misrepresented, you will receive a refund within 14 days of receipt of the Product by us, of the full price you paid for the Product and the costs you incur in returning the item to us.
7.7 In the case of either Clause 8.5 or 8.6, the refund will be made on the credit or debit card used to pay for the order.
7.8 As a consumer, you will always have legal rights in respect of Products that are faulty or misrepresented. See Section 5.2.
8. Delivery
8.1 We aim to dispatch your order within 14 days from placement, but it could take up to 28 days from order to delivery, depending on time of year (e.g. pre-Christmas busy period) and speed of the delivery service (Royal Mail). If there are particular extenuating circumstances (e.g. COVID pandemic and restrictions on office attendance) we will state this on the shop web page.
8.2 If your order is required by a particular date or with special instructions e.g. for a birthday, please use the ‘Add a Note’ function when in your Cart and provide details. If you omit to do this please email sales@badgertrust.org.uk as soon as you have placed your order, giving the instructions and providing your order number. We will do our utmost to meet your request, but cannot guarantee it.

8.3 You will receive an ‘Order Shipped’ email when the order is processed and posted from our shop to you.
9. Price of Products and Delivery Charges
9.1 The price of a Product does not include postage and packing. This cost is calculated for the goods in your Cart and added at Checkout. This is based on weight and country of destination. Additional custom charges added to packages sent outside of the UK by the receiving country postal service are not the responsibility of Badger Trust, and you must pay these.

Badger Trust Wildlife Artivism T-shirt giveaway – Terms and Conditions
These Terms and Conditions are applicable to anyone entering the free prize draw to win an exclusive Badger Trust Wildlife Artivism t-shirt, as advertised on the Badger Trust Instagram page.

By entering the Prize Draw you (“You”, the “Entrant”) accept these Terms and Conditions and agree to be bound by them.

1. The promoter of this prize draw is Badger Trust incorporated and registered in England and Wales with company number 5460677 and registered as a Charity with number 1111440 whose registered office is at 95 Ditchling Road, Brighton, BN1 4ST (the Charity).

2. This prize draw is open to all UK residents aged 18 years or over, except employees of the Charity and their families, agents, or any third party directly associated with the administration of the prize draw.

3. This prize draw is free to enter.

5. Any personal data will be used in accordance with these terms and conditions and our
privacy policy. For more details on how the Charity uses and looks after personal
information, read our privacy notice .
6. You may only submit one entry to this promotion.
7. Entries that do not comply with these promotion rules or which exceed the maximum number of entries will be void and will not be entered into this promotion.
8. The opening date for entries is 5pm (GMT) on Tuesday 07 May 2024. The closing date for this prize draw is 5pm (GMT) Tuesday 21 May 2024. Entries received after this time will not be accepted.
9. The winner will be selected randomly by a computer process that produces a verifiably random result from those valid entries received during the competition period.
10. The winner will be notified via direct message on Instagram on or before Wednesday 22 May 2024. The winner will be asked to email hello@badgertrust.org.uk so we can arrange delivery of the prize. If the winner has not responded to the direct message to accept their prize by Tuesday 28 May 2024, then the winner’s prize will be forfeited, and the Charity will be entitled to re-draw the winner. In these circumstances, the new winner will be notified, and the prize must be accepted in accordance with the process set out above.
11. The prize is a single Badger Trust t-shirt for the winner. The t-shirt will be in the Artivism design shown in the giveaway post and winners will have the choice of an adult (male or female) or child size. The prize is not transferable, and no cash alternative is available.
12. The Charity reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Charity’s control make it necessary to do so.
13. The decision of the Charity regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
14. The winner’s first name and county can be obtained by sending an email to hello@badgertrust.org.uk within 28 days after the date of the closing date of the prize draw.
15. Entrants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Charity reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions.
16. The Charity reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
17. Insofar as is permitted by law, the Charity, its agents, or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Charity, its agents or distributors or that of their employees. Your statutory rights are not affected.
18. Personal data supplied during the course of this promotion may be passed on to third-party suppliers for the purposes of fulfilment/ delivery/ arrangement of the prize.
19. The first name and Instagram handle of the winner will be shared on the Badger Trust Instagram page on or before Wednesday 22 May 2024.
20. The prize draw will be governed by English law and entrants to the prize draw submit to the exclusive jurisdiction of the English courts.
21. The promoter reserves the right to withdraw this offer or amend these Terms and Conditions at any time without notice.
